1. Anna Guo immigrated to the United States with her younger brother over four years ago.

2. In November of 2001, Anna was removed from her father’s home for alleged neglect.

3. In the spring of 2002, Anna was placed in the home of Jack and Peggy Tsui.

4. In May of 2002, Anna was placed in the care of foster parents Robert and Zaida Worthley.

5. Anna threatened to take her own life on the evening of May 5, 2002.

6. Picking up a steak knife from the kitchen, Anna made three phone calls, at least one of them to former foster mother Peggy Tsui, to inform her that she was committing suicide.

7. Anna then retreated to her room with the steak knife.

8. Upon learning of Anna's actions, foster father Robert Worthley took the other foster children into one room and called 911.

9. Foster father Robert Worthley informed the 911 operator that she took a 'samurai sword'.

10. At least five Ventura police officers arrived at the Worthley's residence.

11. Four officers entered the house.

12. Rookie officer Kristin Rupp entered the house.

13. Rupp confronted Anna as she came out of her room and stood at the top of the stairs, holding the steak knife down by her side.

14. Officer Rupp had her gun drawn on Anna.

15. Rupp ordered Anna to put down the knife.

16. Anna descended down the stairs.

17. When Anna reached the foot of the stairs, rookie officer Kristin Rupp opened fire 3 times at Anna stomach and lower body – twice in quick succession, the third shot after a brief pause.

18. Anna was sent to the hospital.

19. An internal investigation was conducted by the Ventura Police Department on rookie officer Kristin Rupp who ultimately found no misconduct. Details of this investigation have not been disclosed.

20. Ventura County District Attorney is now charging Anna with felony assault with a deadly weapon on rookie officer Kristin Rupp.

21. Judge Brian Back of Ventura Superior Court will hear the trial on December 16, 2002.
